It really isn’t. Nobody is challenging the federal government’s authority in the matter. Just whether the CFTC is reading statute correctly.

The Congress could choose to regulate or legalize prediction markets. It hasn’t. It created laws for exempted commodities with Dodd-Frank and the CFTC and Trump sort of ran with that.
